Restaurant premises present special challenges. The condition of the premises on delivery can be critical because the tenant improvements are more expensive and complex than ordinary retail. Parking and seating issues require special attention to local zoning ordinances. Shopping Center exclusives need to be carefully written. On the tenant side, the term of lease needs to be long enough to amortize the high cost of building out a restaurant, with carefully designed extension options, and the lease transfer restrictions should allow the tenant a reasonable opportunity to recover its investment by sale of the restaurant.
